The Golden Residency in the UAE: What Are Its Conditions, the Holder's Rights, and the Risks of Losing It?
The Legal Framework and the Competent Authority
The system for the entry and residence of foreigners in the State rests on the Federal Decree-Law on the Entry and Residence of Foreigners, which sets the general frameworks for visas and residence permits and the controls for issuing and cancelling them. Its Executive Regulations were issued thereunder, dedicating an independent annex to regulating Golden Residency permits as the detailed reference for their categories, conditions, and benefits. The Federal Authority for Identity, Citizenship, Customs and Port Security alone implements these provisions, in coordination with the competent federal and local government entities according to each category. It is worth noting that the current Regulations repealed the previous Cabinet decision on regulating Golden Residency permits, so the annex attached to the Regulations became the governing framework in force.

What Is the Golden Residency and What Is Its Term?
The Golden Residency is a long-term residence permit for a period of ten years, renewable, granted to specific categories of foreigners and their families, enabling them to reside in the State on a self-sponsored basis without the need for a sponsor or host, for the purpose of work, investment, establishing business, or settling in the State. It is granted within the categories specified in the annex, and may also be granted to prominent and influential persons by decision of the Authority's chairman upon the recommendation of the competent entities.

Conditions of the Main Categories
Investors
In public investments: a deposit of not less than AED 2 million in an investment fund or in national banks; or establishing a company with capital of not less than AED 2 million; or a partnership with a share of not less than AED 2 million; or ownership of / partnership in an entity paying taxes of not less than AED 250,000 annually, provided the capital is fully owned and not a loan. In real estate: owning one or more properties with a total value of not less than AED 2 million (which may be financed by a loan from an approved local bank), or purchasing an off-plan unit of the same value from approved local companies. In both cases, comprehensive health insurance for the holder and family is required.
Entrepreneurs
Ownership of, or partnership in, a registered entrepreneurial project within the small and medium enterprises category in an approved field, generating annual revenues of not less than AED 1 million; or obtaining approval of the project idea from an accredited business incubator, the Ministry of Economy, or the competent entities; or being a founder of a prior entrepreneurial project sold for a total value of not less than AED 7 million, together with comprehensive health insurance.
Exceptional Talents
Granted on the basis of talent alone, requiring no employment contract in the State and no minimum educational qualification, salary, or professional level; it suffices to obtain the recommendation/approval of the competent entity according to the field (cultural bodies; the Ministry of Economy for inventors; the General Authority of Sports; or the UAE Council for Artificial Intelligence and Digital Transactions). A residence permit may be issued for the talent's business manager, up to three permits during the term of their residency.
Scientists & Specialists
Granted to scientists and researchers of high achievement and influence upon the recommendation of the Emirates Scientists Council. Specialists are granted it on the basis of employment (active work) under the conditions of: a valid employment contract, belonging to skilled labour at the first or second professional level, a qualification of not less than a bachelor's degree, a monthly salary of not less than AED 30,000, and obtaining a professional practice licence for professions that require it such as doctor, pharmacist, and teacher, with comprehensive health insurance.
Outstanding Students, Graduates & Humanitarian Pioneers
Outstanding students (once, non-renewable): a secondary-school average of not less than 95%, or distinction at accredited universities with a GPA starting from 3.5 according to the university's rating, or graduation from the best 100 global universities. Humanitarian pioneers: membership of international organizations or public-benefit civil associations for not less than five years, obtaining appreciation awards, or material support of not less than AED 2 million. Frontline heroes are granted it to cadres confronting the COVID pandemic upon the recommendation of the Pride of the Nation office.
Rights and Benefits of the Golden Residency Holder
Sponsoring the Family
Issuing residence permits for family members including the spouse and children regardless of age, and the parents, for ten years, renewable.
Support Services Labour
Recruiting support services (domestic) workers in accordance with the holder's financial solvency.
Preliminary Entry Visa
An eligible person abroad is granted a six-month multiple-entry visa, renewable for a further six months to complete procedures.
Family Continuity After Death
In the event of the breadwinner's death, dependent family members may remain in the State throughout the validity of the residency granted to them.
In addition, the essential feature of the Golden Residency is that it is a self-sponsored residency not tied to an employer or sponsor, granting its holder occupational and investment stability and flexibility in organizing their affairs within the State.
How to Apply
An eligible foreigner may apply for the Golden Residency permit in one of two ways: direct application through the Authority's platform, or via nomination/recommendation from the competent federal or local government entity. The Authority undertakes the study of the application and verification of the fulfilment of conditions before issuing the permit.
Conditions for Retaining the Golden Residency
Granting the residency is one thing; retaining it is another. The annex expressly requires the following for the permit to continue:
1The ability to support oneself and one's family without government support.
2Maintaining valid health insurance for oneself and one's family members throughout the residency's validity.
3The Authority may take the necessary measures to verify the continued fulfilment of these conditions throughout the term of the permit.
Importantly, the retention conditions in the annex do not include the limit on duration of stay outside the State applicable to ordinary residence — the Regulations provide that an ordinary residence permit is deemed void if its holder stays outside the State for more than one hundred and eighty consecutive days, whereas this restriction does not appear among the provisions of the Golden Residency, which is one of its most distinctive features.
Risks of Losing the Golden Residency
Despite the robustness of the Golden Residency, it is not immune from lapsing. The following are the most important legal risks that may lead to its loss:
Failure to meet retention conditions: a lapse in health insurance or an inability to support oneself and one's family without government support renders the holder in breach of the conditions for its continuation, and the Authority may verify this at any time.
Loss of the qualifying status at renewal: the permit is renewed according to the same criteria and conditions under which it was granted; so if that status lapses — such as selling the property on which an investor's residency was based, the end of the investment activity, or the termination of the employment contract in the specialists category — renewal may not be accepted.
Cancellation for public interest or breach of the law: the Decree-Law permits the Authority's chairman to cancel any visa or residence permit at any time before its expiry, for reasons relating to the public interest or in the event of the foreigner's breach of the provisions of the Decree-Law, its Regulations, or the decisions issued in its implementation.
Judicial or administrative deportation: a foreigner may be deported even if holding a residence permit if a judicial deportation ruling is issued against them, or administratively where required by the public interest, public security, public morals, or public health, and the deportation order may include family members they are responsible for supporting.
Golden Residency and Tax Residency: A Necessary Distinction
Many confuse residence as a status regulated by the laws on entry and residence of foreigners with tax residency, which is regulated by a separate decision on determining tax residency. Holding the Golden Residency does not automatically make its holder a tax resident; for a natural person to be considered a tax resident it is required that their centre of financial and personal interests be in the State, or that they be physically present therein for one hundred and eighty-three days or more within twelve months, or for ninety days together with holding the State's nationality or a valid residence and other controls. It is therefore advisable to treat the two matters separately in legal and tax planning.

Does the Golden Residency lapse if its holder stays abroad for a long period?+
